- NAME. The Club shall be known as the Duffield Squash & Racketball Club
- OBJECT. To provide for its members the facilities for playing the game of Squash Rackets and Racketball.
- GROUND. The Club premises are at 23, Town Street, Duffield, Derby. The freehold is held by the Duffield Sports Club Ltd, a limited company of which 5 members are joint and equal shareholders with 5 members of the Duffield Tennis Club.
- RULES. Every member shall be bound by and submit to the Rules and Byelaws of the Club, the Committee having the sole right of interpretation. The rules themselves may only be rescinded, altered or added to at a General Meeting.
- MANAGEMENT. The management and control of the funds and affairs of the Club shall be vested in the Officers and Committee who shall be empowered to make, repeal and amend any byelaws they consider necessary.
- OFFICERS AND COMMITTEE. The Officers of the Club shall be a President, a Secretary and a Treasurer. The Committee shall consist of 10 members with the power to co-opt, who shall elect a Chairman from amongst their numbers. They shall hold office from the time of election until the end of the next AGM. Nominations shall be made in writing to the Secretary not less than 7 days prior to the meeting. Five members shall form a quorum and any decision shall be reached by a simple majority, with the Chairman holding a casting vote.
- GENERAL MEETING. An Annual General Meeting shall be held to certify the Minutes of the previous meeting, receive the Annual Report, elect the Officers and Committee and determine any other business of which prior notice has been given. An extraordinary meeting may be called at the discretion of the Committee or within 3 weeks of written request of 20 members. Notice of general meetings, giving the time , date and business will be sent to all members over 18. Only Full and Restricted members attending the meeting shall be entitled to vote.
- MEMBERSHIP. A candidate for membership shall complete and submit an appropriate application form to the Club. The candidate shall be deemed to be a member when elected by the Committee and on payment of the entry fee and subscription required. Applications will be considered and accepted with no unlawful or unfair discrimination.
- SUBSCRIPTION. Subscriptions shall fall due on 1st September each year and are for the period ending 31st August the following year. Members who have not paid by the 1st October will be issued with a reminder. If the subscription remains unpaid within 7 days of the reminder, the membership will cease. A levy will be imposed for late payment of fees.
- VISITORS. A member may introduce a visitor to the Club on payment of the appropriate fee. All visitors – playing or non playing – and members names must be entered in the Visitors Book on entry to the Club. No visitor may attend as a playing visitor on more than 3 occasions in any year ending 31st August.
- PENALTY. The Committee shall have the power to expel a member when, in their opinion [which shall be final], it would not be in the interests of the Club for that person to remain a member if :
- they shall commit any serious breach or a series of persistent breaches of the Rules or Byelaws of the Club
- they shall behave in any way that is inconsistent with the best interests of the Club or act in any manner contrary to the good faith which ought to be observed between members or
- he shall behave in such a way likely to bring the Club into disrepute.
- USE OF THE CLUB. The Club facilities will normally be available between the hours of 9.00am. and 11.00pm. Access to the building may be made with a key or card which will be available to each member on a deposit. The key or card will remain the property of the Club and shall be returnable on cessation of membership.
- UNINCORPORATED CLUB. The club is a non-profit making organisation. All profit and surpluses will be used to maintain or improve the club’s facilities. No profit or surplus will be distributed other than to a non-profit making body or to members on winding up or dissolution of the club.
- BYELAWS. There are currently 4 sets of Bye-Laws which are displayed in the Club and sent to members as appropriate. One defines the various membership categories, two regulate the use of the squash courts and gymnasium and the other regulates the use of the Car Park. The last one is determined by the ‘Duffield Sports Club Ltd’, the legal owners of the property and states – “The car park is provided exclusively for the benefit of Tennis and Squash & Racketball Club members using the premises – with the exception that members only may use it at off peak times [i.e. 9.00 a.m., to 4.00 p.m.] for purposes unconnected with the club provided that it is of short term [i.e. no more than 1 hour] nor of a regular nature. Longer more frequent use at off peak times may be considered but would have to be with prior agreement of the Sports Club.”
